These Terms are an agreement between you and Aram Abramian ("Bubba," "we," "us") about your use of the Bubba app. By creating an account or using Bubba, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Bubba.
Bubba helps you record your baby's care and spot patterns. It isn't a medical device, and it doesn't diagnose, treat, or prevent any condition.
To use Bubba, you must be at least 18 years old and either a parent or legal guardian, or a caregiver invited by one. Give accurate information when you sign up, keep your login secure, and use only one account per person. You're responsible for activity on your account.
The account owner can invite co-parents and caregivers, change their roles, and remove them at any time.
Only invite people you trust with your baby's information. Invited family members use Bubba through the owner's subscription, so when that subscription ends, their access ends too.
You own what you put into Bubba, including your baby's log, your notes, and your community posts. You give us a limited license to host, store, sync, and display that content only as needed to run Bubba: to show your log to you and the people you invite, and to show your community posts to the people who can see them. The license ends when you delete the content or your account. It doesn't cover copies other people already made, such as a post someone shared as an image.
You're responsible for what you post, and you confirm you have the right to post it.
If you send us feedback or ideas, we're free to use them without owing you anything.
The community is meant to be a kind place for tired parents. We have zero tolerance for objectionable content and abusive users. Don't post:
Posting anonymously hides your name from other parents, but not from us. Anyone with a private group's invite code can join that group, so share codes carefully.
Reporting and blocking. You can report any post or reply you think breaks these rules, and the author isn't told who reported it. You can block anyone to stop seeing their content. We review reports and aim to act on them within 24 hours. We may remove content, and suspend or ban accounts that break these rules, with or without notice.
We don't review posts before they appear, and we aren't responsible for what other users say.
Don't:
Bubba, including its design, code, and name, belongs to us and our licensors. We give you a personal, non-transferable, revocable license to use Bubba on Apple devices you own or control, under these Terms and the App Store's Usage Rules.
We may add, change, or remove features. We work to keep Bubba available and your data safe, but Bubba may sometimes be unavailable, and data can be lost. Keep your own copy of anything important, such as the doctor's report.
You can delete your account at any time in Settings. We may suspend or close your account if you break these Terms, if it's needed to protect other people, or if we stop offering Bubba. When we reasonably can, we'll give you notice first. Sections 5 and 11 through 17 still apply after your account ends.
BUBBA IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T PROMISE THAT BUBBA, ITS PREDICTIONS, OR COMMUNITY CONTENT WILL BE ACCURATE, COMPLETE, UNINTERRUPTED, OR ERROR-FREE.
TO THE FULLEST EXTENT THE LAW ALLOWS, WE AREN'T LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST DATA OR PROFITS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO BUBBA IS LIMITED TO THE GREATER OF WHAT YOU PAID FOR BUBBA IN THE 12 MONTHS BEFORE THE CLAIM, OR US$50.
Some places don't allow these limits, so they may not apply to you. Nothing in these Terms limits rights you have under consumer protection laws that can't be waived.
If someone brings a claim against us because of content you posted or because you broke these Terms, you agree to cover our reasonable costs, including legal fees, to the extent the law allows.
These Terms are governed by the laws of the State of [STATE], USA, without regard to its conflict-of-law rules. Before filing a claim, please contact us at bubbasupport@gmail.com so we can try to resolve it informally. If we can't, the dispute will be decided in the state or federal courts in [COUNTY], [STATE], and you and we both agree to their jurisdiction. If you live somewhere that gives consumers the right to bring claims in their local courts, such as the EU or UK, you keep that right.
We may update these Terms. If we make a material change, we'll tell you in the app or by email before it takes effect. If you keep using Bubba after that, the updated Terms apply.
If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a provision right away, we haven't waived it. You can't transfer these Terms to someone else. We can transfer them as part of a merger, acquisition, or sale. These Terms and the Privacy Policy are the entire agreement between you and us about Bubba.
